1. Introduction
This Terms of Use Agreement ("Agreement") governs your use of all applications ("Services") provided by Future Dream Entertainment Limited ("we," "us," or "our"). By accessing or using our Services, you accept and agree to be bound by these terms. If you do not agree, do not access or use our Services.
App Store Acknowledgments:
When downloading our applications via Google Play, you acknowledge:
- This Agreement is between you and us—not the Google Play.
- Bears no obligation for app maintenance, support, or warranty claims.
- Has no liability for claims (e.g., product liability, consumer protection, IP infringement, or regulatory compliance).
- The Google Play is a third-party beneficiary with enforcement rights under this Agreement.
- You must comply with the Google Play’s terms of service.
2. License & Service Scope
We grant you a limited, non-exclusive, revocable license to use our Services for personal, non-commercial purposes if you comply with this Agreement.
AI Results Disclaimer: Our Services primarily offer AI image processing. We do not guarantee 100% expected results—they are intended for entertainment only.
We reserve the right to modify, suspend, or terminate any Service (or feature) at any time.
3. Eligibility and Minors Terms of Use
Eligibility
You may use our Services only if:
- You are at least 13 years old.
- If under 18 (or local age of majority), you must be supervised by a parent/guardian who accepts this Agreement.
- If using on behalf of an entity, you warrant authority to bind that entity.
Children and Minors Terms of Use
a. Users Under 13
Our application is not intended for children under the age of 13. We do not knowingly collect personal information from children under 13. If we discover and verify that a child under 13 has used our Services, we will take the following reasonable steps:
Immediately disable the account associated with the minor user.
Permanently delete any personal data we may have collected from that child, in accordance with applicable data protection laws (such as the Children’s Online Privacy Protection Act (COPPA) or the General Data Protection Regulation (GDPR)).
Our legal obligation to protect children's data is independent of any commercial dispute over financial liability. For any purchases made within the app, please refer to Sections 4 and 5 of these Terms of Use.
b. Minors Between the Age of 13 and the Age of Legal Majority
If you are between the age of 13 and the age of legal majority in your country (usually 18, but may vary by jurisdiction), you may only use our application under the supervision and explicit consent of a parent or legal guardian who has read and agreed to these Terms. By allowing such a minor to use the application, the parent or guardian:
Bears full responsibility for the minor’s use of our services, including any interactions, content consumption, and financial transactions.
Confirms that they will supervise the minor’s activities and ensure compliance with these Terms.
Acknowledges and agrees that it is their absolute responsibility to actively enable and maintain all available parental control and purchase authentication settings provided by Google Play and their device (such as password protection, biometric verification, and purchase approval requirements) to prevent unauthorized or accidental purchases by minors.
Accepts that any financial transactions arising from the minor’s use, including in-app purchases and subscriptions, are deemed authorized by the parent/guardian, and the parent/guardian shall assume full financial liability for such charges.
Agrees that we shall not be liable for any refunds, losses, or damages resulting from the parent/guardian’s failure to supervise the minor or to implement the aforementioned protective controls, and such purchases are typically non-refundable by us.
c. Content Commitment
We guarantee that our application does not contain any content that is objectively inappropriate for minors, such as pornographic content, violent imagery, hate speech, or gambling-related features. The application is designed to be safe for users aged 13 and above.
d. Disclaimer
To the maximum extent permitted by law, we shall not be liable for:
Unauthorized use of the application by a minor who has misrepresented their age or bypassed parental controls.
Any purchases, losses, or damages arising from unsupervised use of the application by a minor.
Any claims of unauthorized transactions where the parent or guardian has failed to secure their device, payment credentials, or Google Play account, or has failed to utilize available parental controls.
In the event of a dispute regarding whether a purchase was made by a minor without authorization, the final transaction determination made by the app store (Google Play) shall serve as the primary and conclusive basis for our refund decision. We do not undertake any obligation to independently re-investigate or second-guess the app store’s transaction verification outcome.
We encourage parents and guardians to use the parental control tools available on Google Play and their devices to manage and restrict in-app purchases.
4. Premium Subscriptions and Billing Authorization
By subscribing to premium services ("Pro Services"):
- You agree to auto-renewing recurring payments at the then-applicable fee.
- Payments are processed via Google Play.
- Billing cycles are weekly, monthly or annual, starting at subscription date.
- Billing Authorization and Account Responsibility
- You are solely responsible for maintaining the security and confidentiality of your Google Play account credentials, your device passcode, and any biometric identifiers (fingerprint, face) used for payment authentication.
- All purchases and subscription charges initiated through your Google Play account and authenticated via your stored payment method are conclusively deemed to have been made and authorized by you, regardless of the actual operator of the device. You assume full financial liability for all such charges.
- You are strongly advised to regularly review your active subscriptions and purchase history via Google Play. Your failure to do so does not relieve you of your payment obligations for charges already incurred.
- You acknowledge that Google Play offers security features, including purchase authentication requirements and parental controls. You agree that it is your responsibility to enable and maintain these settings. We shall not be liable for any transactions that could have been prevented by your use of such features.
5. Refund Policy and User Support Terms
Scope
These terms apply to purchases made through our application (including one-time purchases and subscriptions). We voluntarily provide this refund policy as an additional user safeguard and it does not affect any rights you may have under Google Play’s refund policies or applicable law.
Refund Policy
You may first review Google Play’s refund policy. For purchases made through Google Play’s billing system in our app, Google may provide refunds according to its policies. These policies vary depending on the item purchased, the payment method, the timing, and your location. a. Refund Request
If you wish to request a refund for an order, please contact us at the support email address provided at the bottom. In your email, please include the order number (the transaction ID beginning with GPA), the purchase date, and the reason for the refund so that we can verify the details as quickly as possible.
b. Review Period
Due to limited operational resources, the refund review typically takes 3 to 5 business days. Once the review is complete, we will notify you of the outcome by email. If any delay occurs due to exceptional circumstances, we will also inform you via email in advance.
c. Refund Eligibility
We evaluate refund requests according to the following principles:
- In-app Purchases (including consumables): If you purchase an in-app item but do not receive it, or if the item’s functionality or performance is materially inconsistent with the product description in the application, you may be eligible for a refund. However, once virtual currency or other consumable items have been credited to your account and used, they become non-refundable.
- Subscriptions: You may cancel your subscription at any time to avoid being charged for the next billing cycle. Fees already paid for the current subscription period are generally non-refundable, unless a technical fault in our application prevents you from using the core subscription features and we are unable to resolve the issue within a reasonable time.
- Unauthorized Transactions or Account Sharing: Our app uses Google Play’s payment system to process purchases, and Google Play itself has a robust anti-fraud model in its payment system. If you notice a Google Play purchase on your payment method that was not made by you or someone you know, or if a friend or family member has used your account or payment method without your authorization, we are not responsible for verifying or handling such situations. You may review Google Play’s refund policy and submit an "unauthorized purchase" dispute to Google. If, after Google Play’s review, the relevant order is found to qualify as an unauthorized transaction, Google Play will issue you a refund. Furthermore, if you have shared your account or payment information with others and we reasonably suspect a violation of our policies, we will not be liable for this, and such orders will generally not be eligible for a refund from us.
- We are not responsible for, and have no obligation to, independently verify the identity of the person making the purchase beyond the authentication already performed by Google Play. The burden of proving that a transaction was truly unauthorized rests solely with you. Any purchase made as a result of your failure to secure your device, payment credentials, or Google Play account, or your failure to utilize parental controls, is attributable to your own negligence and is strictly non-refundable from us.
- Other Non-Refundable Situations: Requests made beyond a reasonable timeframe; refund requests arising from reasons attributable to you (such as accidental purchase, change of mind, or buyer’s remorse); and any cases involving refund abuse or fraudulent activity.
e. Refund Method
Approved refunds will be returned to the original payment method linked to your Google Play account. The actual time it takes for the funds to appear in your account depends on the processing speed of your card issuer or payment provider and may typically take several days to a few weeks.
f. Relationship with Google Play Refunds
You always have the right to request a refund directly through the Google Play Store; that process is handled and decided independently by Google. If you obtain a refund via Google for an order, we will not process an additional refund for the same order. This policy does not limit any rights granted to you under Google Play’s policies or applicable law.
6. Privacy
Your use of our Services is subject to our Privacy Policy, governing how we collect, use, and disclose your information.
7. User Content
a. Rights & Licenses
"User Content" includes photos, videos, text, or materials you create/share via our Services.
You retain ownership rights between us.
You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your User Content solely to provide the Services.
b. Advertising
You acknowledge:
- Services may display ads/revenue-generating content.
- Ads may appear alongside your User Content.
- Ad formats may change without notice.
c. Your Warranties
You represent that:
- You own/have rights to all User Content you share.
- You will pay all royalties/fees owed for User Content.
- You have legal capacity to enter this Agreement.
8. Intellectual Property & Security
No Backup Service: We do not provide User Content backup/storage. We are not liable for content loss or service interruptions.
IP Ownership: All Service-related IP (software, content, technology) is owned by us or our suppliers and protected globally.
Feedback: We may use your suggestions/feedback without obligation.
9. Prohibited Conduct & Content
a. Conduct Restrictions
You agree not to:
- Violate laws or third-party rights (e.g., contracts, IP).
- Harass, threaten, intimidate, or stalk others.
- Use another’s account without authorization.
- Disrupt Services or impair functionality (e.g., overburdening servers).
- Reverse engineer, circumvent security, or access unauthorized areas.
- Develop unauthorized third-party apps interacting with our Services.
- Use Services for illegal purposes or encourage violations.
b. Content Restrictions
Do not create/share User Content that:
- Is unlawful, defamatory, obscene, harassing, fraudulent, or privacy-invasive.
- Encourages criminal activity or violates laws.
- Infringes IP rights.
- Contains false/misleading claims.
- Impersonates others or promotes unsolicited ads.
- Exposes private third-party information.
- Contains viruses/destructive code.
- Is objectionable (at our sole discretion).
c. Copyright Claims
To report infringement, provide our Copyright Agent with:
- Your signature (physical/electronic).
- Identification of the copyrighted work.
- Location of infringing material on our Services.
- Your contact information (address, phone, email).
- A statement of good-faith belief that use is unauthorized.
- A statement, under penalty of perjury, that your notice is accurate.
10. Third-Party Services
Our Services may link to third-party content/services.
We do not endorse or control these services.
Use at your own risk—we are not liable for their content/practices.
11. Indemnification
To the fullest extent permitted by law, you will Indemnify Future Dream Entertainment Limited and its affiliates against claims/losses arising from:
- Your use of Services.
- Your User Content/Feedback.
- Your breach of this Agreement.
- Violations of third-party rights.
- Notify us promptly of third-party claims.
- Cooperate in defense and cover related fees (including attorneys’ fees).
12. Disclaimers
Our Services are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties (express/implied), including:
- Merchantability, fitness for purpose, title, and non-infringement.
- Accuracy, completeness, reliability, or error-free operation.
We are not liable for User Content or third-party content.
