1. Introduction
This Terms of Use Agreement ("Agreement") governs your use of all applications ("Services") provided by Future Dream Entertainment Limited ("we," "us," or "our"). By accessing or using our Services, you accept and agree to be bound by these terms. If you do not agree, do not access or use our Services.
App Store Acknowledgments:
When downloading our applications via Google Play, you acknowledge:
- This Agreement is between you and us—not the Google Play.
- Bears no obligation for app maintenance, support, or warranty claims.
- Has no liability for claims (e.g., product liability, consumer protection, IP infringement, or regulatory compliance).
- The Google Play is a third-party beneficiary with enforcement rights under this Agreement.
- You must comply with the Google Play’s terms of service.
2. License & Service Scope
We grant you a limited, non-exclusive, revocable license to use our Services for personal, non-commercial purposes if you comply with this Agreement.
AI Results Disclaimer: Our Services primarily offer AI image processing. We do not guarantee 100% expected results—they are intended for entertainment only.
We reserve the right to modify, suspend, or terminate any Service (or feature) at any time.
3. Eligibility
You may use our Services only if:
- You are at least 13 years old.
- If under 18 (or local age of majority), you must be supervised by a parent/guardian who accepts this Agreement.
- Parents/guardians are solely responsible for minors’ use of our Services.
- If using on behalf of an entity, you warrant authority to bind that entity.
4. Premium Subscriptions
By subscribing to premium services ("Pro Services"):
- You agree to auto-renewing recurring payments at the then-applicable fee.
- Payments are processed via Google Play.
- Billing cycles are weekly, monthly or annual, starting at subscription date.
5. Refund Policy and User Support Terms
Scope
These terms apply to purchases made through our App (including one-time purchases and subscriptions). This refund policy is voluntarily provided by us as an additional user safeguard and does not affect any rights you may have under Google Play’s refund policies or applicable law.
Refund Policy
a. Refund Request
If you wish to request a refund for an order, please send a request to our support email address below. In your email, please include the order number (the transaction ID beginning with GPA), the purchase date, and the reason for the refund so that we can verify the details as quickly as possible.
b. Acknowledgment of Receipt
Upon receiving your refund request email, we will promptly send you a confirmation reply to acknowledge that we have begun processing it.
c. Review Period
Due to limited operational resources, the refund review typically takes 7 to 14 business days. Once the review is complete, we will notify you of the outcome by email. If any delay occurs due to exceptional circumstances, we will also inform you via email in advance.
d. Refund Eligibility
We assess refund requests based on the following principles:
- Subscriptions: You may cancel your subscription at any time to avoid being charged for the next billing cycle. Fees already paid for the current subscription period are generally non-refundable, unless the core service becomes completely unusable during that period due to a technical fault that we are unable to fix within a reasonable time.
- Consumable Digital Content (e.g., virtual currency, in-app items): Once such content has been credited to your account and consumed, it is non-refundable.
- Unauthorized Transactions: If you believe a transaction was not made or authorized by you, please provide relevant proof when submitting your request. We will prioritize the investigation.
- Duplicate or Erroneous Charges: Once confirmed, we will fully refund any overcharged amount.
Non-Refundable Situations: Requests made beyond the reasonable timeframes set out above; refund requests arising from reasons attributable to you (such as accidental purchase, change of mind, or device incompatibility that was clearly disclosed prior to purchase); and cases involving refund abuse or fraudulent activity.
e. Refund Method
Approved refunds will be returned to the original payment method linked to your Google Play account. The actual time it takes for the funds to appear in your account depends on the processing speed of your card issuer or payment provider and may typically take several days to a few weeks.
f. Relationship with Google Play Refunds
You always have the right to request a refund directly through the Google Play Store; that process is handled and decided independently by Google. If you obtain a refund via Google for an order, we will not process an additional refund for the same order. This policy does not limit any rights granted to you under Google Play’s policies or applicable law.
User Support
We want you to have a smooth experience. If you encounter any issues or have any questions, please feel free to contact us at the email address below. We will respond to your email within 1 to 3 business days.
We will do our best to assist you in diagnosing and resolving any problems, but please understand that we may not be able to fully resolve matters beyond our reasonable control (such as device compatibility issues, operating system limitations, and similar constraints).
6. Privacy
Your use of our Services is subject to our Privacy Policy, governing how we collect, use, and disclose your information.
7. User Content
a. Rights & Licenses
"User Content" includes photos, videos, text, or materials you create/share via our Services.
You retain ownership rights between us.
You grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, and display your User Content solely to provide the Services.
b. Advertising
You acknowledge:
- Services may display ads/revenue-generating content.
- Ads may appear alongside your User Content.
- Ad formats may change without notice.
c. Your Warranties
You represent that:
- You own/have rights to all User Content you share.
- You will pay all royalties/fees owed for User Content.
- You have legal capacity to enter this Agreement.
8. Intellectual Property & Security
No Backup Service: We do not provide User Content backup/storage. We are not liable for content loss or service interruptions.
IP Ownership: All Service-related IP (software, content, technology) is owned by us or our suppliers and protected globally.
Feedback: We may use your suggestions/feedback without obligation.
9. Prohibited Conduct & Content
a. Conduct Restrictions
You agree not to:
- Violate laws or third-party rights (e.g., contracts, IP).
- Harass, threaten, intimidate, or stalk others.
- Use another’s account without authorization.
- Disrupt Services or impair functionality (e.g., overburdening servers).
- Reverse engineer, circumvent security, or access unauthorized areas.
- Develop unauthorized third-party apps interacting with our Services.
- Use Services for illegal purposes or encourage violations.
b. Content Restrictions
Do not create/share User Content that:
- Is unlawful, defamatory, obscene, harassing, fraudulent, or privacy-invasive.
- Encourages criminal activity or violates laws.
- Infringes IP rights.
- Contains false/misleading claims.
- Impersonates others or promotes unsolicited ads.
- Exposes private third-party information.
- Contains viruses/destructive code.
- Is objectionable (at our sole discretion).
c. Copyright Claims
To report infringement, provide our Copyright Agent with:
- Your signature (physical/electronic).
- Identification of the copyrighted work.
- Location of infringing material on our Services.
- Your contact information (address, phone, email).
- A statement of good-faith belief that use is unauthorized.
- A statement, under penalty of perjury, that your notice is accurate.
10. Third-Party Services
Our Services may link to third-party content/services.
We do not endorse or control these services.
Use at your own risk—we are not liable for their content/practices.
11. Indemnification
To the fullest extent permitted by law, you will Indemnify Future Dream Entertainment Limited and its affiliates against claims/losses arising from:
- Your use of Services.
- Your User Content/Feedback.
- Your breach of this Agreement.
- Violations of third-party rights.
- Notify us promptly of third-party claims.
- Cooperate in defense and cover related fees (including attorneys’ fees).
12. Disclaimers
Our Services are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties (express/implied), including:
- Merchantability, fitness for purpose, title, and non-infringement.
- Accuracy, completeness, reliability, or error-free operation.
We are not liable for User Content or third-party content.
